payment of the Fee.

- USE OF SERVICES

4.1 The term "Services" refers to and encompasses the following
diagnostic tests and health packages offered by the Company at
its most advanced, state-of-the-art testing facilities.

"onCORE" - Complete diagnostic options for inherited and
sporadic malignancies

"hemaCORE" - Clear and accurate diagnostic answers for a
variety of hematological illnesses.

"reproCORE" - Reproductive health solutions for infertility,
pregnancy, and sexual health
-
cardioCORE - Genetic diagnostics for cardiovascular disorders
and noninvasive tests for heart blockage
-
endoCORE - Diagnostics of hereditary endocrine abnormalities
characterized by a spectrum of symptoms and severity.

"nephroCORE" - Detection of kidney disorders earlier than
conventional diagnostic methods.
-
'uroCORE' refers to the detection of urological problems of
the urinary system, bladder, and prostate.
-
Specialist testing for ophthalmologic problems; eyeCORE.
neuroCORE is genetic testing and counseling for the diagnosis
of brain and nervous system problems.

Comprehensive Health Packages that include two or more of the
aforementioned tests.

Any additional tests or health packages offered by the Company
4.2 Your use of the Website authorizes you to access the
Services (subject to the completion of the registration process)
in the manner described below:

To check the test/health package(s) available on the website
and reserve the test/health package(s) that meet your needs.
- Choose one of the alternatives. i.e.

Visiting at any of our testing facility(s) to give sample or

Home Service (if available, at the nearest testing facility)
in which case the Company will send its representative(s) to
Your home for sample collection.

After sample collection, You will receive your order ID and
other details via e-mail on your registered e-mail ID or via
sms/WhatsApp on your registered mobile number;

Once your test report is ready, You will receive a link to
download your test report via e-mail on your registered e-mail
ID or via sms/WhatsApp on your registered mobile number.
4.3 The Services are non-transferable, meaning that only the
individual whose name is given to the test/health package(s) at
the time of booking is eligible to use the Services.
4.4 The Services must be reserved at least one day in advance,
before 5 p.m. on a work day, in order to be utilized. If a
reservation is made after 5 p.m. on a business day, the sample
will not be collected until the next business day.
4.5 You must bring a photo identification card and Your Order ID
to the testing center or when requesting Home Service.
4.6 When submitting a sample for the test/health package, you
will be expected to precisely adhere to the
instructions/guidelines provided on the company's website (s).
4.7 The Company maintains the right to modify the nature of the
Services outlined in section 4.1 at its sole discretion and by
posting an announcement on the Website.
4.8 You are solely responsible for your activities when using
the Website to access the Services, and CORE shall not be liable
for such actions.
4.9 You represent that, despite anything to the contrary
provided elsewhere in this Agreement, you are not a person
forbidden from obtaining the Services under the laws of India.
4.10 You confirm and agree that CORE shall not be accountable or
responsible for any deficiency in payment of consideration due
for the Services booked by You via the Website. CORE is not
obligated to furnish you with a Test report in the event that
you fail to pay the agreed-upon fee. 4.11 CORE shall not provide
a refund for Services booked via the Website unless a mistake
occurred during the booking process.

- INTELLECTUAL PROPERTY AND PROPERTY RIGHTS

All rights, title, and interest in and to the Website, all
content, code, data, and materials thereon, the look and feel,
design, and organization of the Website, and the compilation of
the content (for instance, text, audio, photographs,
illustrations, other visuals, copy, etc.), and other materials on
the Website, including but not limited to any copyrights,
trademark rights, patent rights, moral rights, and other
intellectual property and proprietary rights. Your use of the
Website does not grant you ownership of any content, code, data,
or other materials accessible through the Website. The use or
exploitation of the Website for commercial purposes is strictly

disclosed by a Party or its employees, agents, or contractors
(collectively, the "Disclosing Party") to the other Party, its

given the nature of the information or the circumstances
surrounding its disclosure, reasonably should be regarded as
confidential. Confidential Information includes, with respect to
the Company, nonpublic information relating to the Company's
technology, methods, processes, customers, business plans,
business and operating processes, promotional and marketing
activities, finances, and other business affairs, as well as,
with respect to You, the personal information disclosed by You
while making a booking and the information relating to Your
Account, username or password, and Your test report (s).
6.2 The Receiving Party will at all times protect the
confidentiality of all Confidential Information pertaining to
the Disclosing Party and ensure that its agents, employees,
contractors, and Affiliates do the same. The Receiving Party
will take all reasonable precautions to prevent the disclosure,
dissemination, or unauthorized use of Confidential Information
by it or any third party, including at a minimum the same
precautions it takes to protect its own Confidential Information
of a comparable kind. The Receiving Party will not utilize the
Disclosing Party's Confidential Information for any purpose
other than those expressly stated below.
6.3 The obligations set forth in Clause 6.2 do not apply if and
to the extent that the Receiving Party establishes that: (a) the
Confidential Information disclosed to the Receiving Party was
already known to the Receiving Party without obligation to keep
it confidential; (b) the Receiving Party received the
Confidential Information in good faith and without restriction
from a third party lawfully in possession thereof without
obligation to keep such Confidential Information confidential;
or (c) the Receiving Party independently developed the (f) the
Confidential Information must be revealed by Applicable Law or
by judicial or administrative proceedings.

- INDEMNIFICATION

8.1 Immediate Damages In the event that any Party breaches these
Terms of Service, in addition to any other remedies provided by
these Terms of Service or applicable law, the non-breaching
Party shall be entitled to recover from the breaching Party only
the actual and direct damages incurred by the non-breaching
Party as a result of the breach.
8.2 Consequential Damages IN NO EVENT SHALL EITHER PARTY, A
PARTY'S DIRECT OR INDIRECT AFFILIATES, AGENTS, SUPPLIERS,
EMPLOYEES OR REPRESENTATIVES BE LIABLE FOR (I) ANY INDIRECT,
INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL
DAMAGES OF ANY KIND ARISING IN CONNECTION WITH OR ARISING OUT OF

- MODIFICATION OF WEBSITE AND TERMS OF USE

shall continue in effect as long as your Account is active.
11.2. The Company reserves the right to terminate Your Account
at any time in the following situations: a. if Your Account
remains inactive for a period of six months or more; b. if, in
the Company's sole discretion, You have breached any of the
terms and conditions governing Your Use of the Website or
Services; or c. if Your Account has been inactive for more than
one year.
11.3 Regardless of the termination of Your Account, all clauses
herein that, by their very nature, are intended to survive
termination of Your Account will continue to bind you even after
termination of Your Account.

- RESULTANTS AND OBLIGATIONS UPON TERMINATION

You are not entitled to a refund if Your Account is cancelled due
to a violation of any of the terms and conditions of the Use of
Website or Services, without prejudice to any other remedies
available to the Company.

- GOVERNING LAW AND JURISDICTION

The legality, interpretation, and enforcement of these Terms of
Service shall be governed in every way by Indian law. The parties
agree that only the courts in Gurugram shall have jurisdiction to
try and decide any dispute arising out of, relating to, or
concerning any of the provisions included herein, to the exclusion
of all other courts.

- DISPUTE RESOLUTION

If a dispute or disagreement arises between the Company and You
regarding the Terms of Use of the Website or the Services or the
rights or liabilities of the parties hereunder, then (without
prejudice to other express or implied rights or powers) the
dispute or disagreement ("the Dispute") shall be resolved as
follows:

A party may not initiate court actions (other than proceedings
seeking interlocutory relief) with respect to a Dispute
arising under this Agreement unless it has complied with this
provision.

A party asserting that a Dispute has arisen under this
Agreement must provide the other party with written notice of
the Dispute's particulars.

The parties shall initially attempt to resolve such Disputes
through mutual dialogue. The Dispute shall be submitted to
arbitration in accordance with the Arbitration & Conciliation
Act, 1996, or any statutory amendment or re-enactment thereof
in place at the time. The location of the arbitration will be
either Gurugram or New Delhi. The arbitral proceedings must be
performed in English, and any and all awards must be rendered
in English. The arbitral proceedings shall be governed by
Indian law. The arbitrator's decision shall be final,
conclusive, and binding on both parties.

- MISCELLANEOUS

16.1 Assignment: The Company may, at any time and in its sole
discretion, assign some or all of its obligations to a third
party without providing You with prior notice. You may not
assign, sublicense, or otherwise transfer any of your rights
under this Agreement to a third party without the Company's
prior written consent.
16.2 Severability: If any provision contained herein is
determined to be invalid, unenforceable, or prohibited by law,
such provision shall be ineffective, but the remainder of these
Terms of Service shall remain valid, enforceable, and have the
same effect as if such provision had not been included herein.
16.3 Any delay or omission by a party in exercising any right,
power, or remedy under this Agreement will not operate as a
waiver of that right, power, or remedy or any other right,
power, or remedy, and no waiver will be effective unless it is
in writing and signed by the waiving party. In addition, the
waiver or single or partial exercise of any right, power, or
remedy by either party on one occasion shall not be construed as
a continuing waiver of any subsequent or other rights, powers,
or remedies on another occasion.
16.4 Privacy Policy: Our Privacy Policy governs the use of the
Website and/or the Services. Before using the Website and/or the
Services, you must therefore read and agree to the terms of our

The Business does not access, store, or retain payment card
information. The specialized software processes all credit card
transactions through banks or third-party gateways, and the
company has no role in the transactions beyond referring
customers to the appropriate gateways or webpage. Hence, CORE is
not liable for any loss or harm resulting from any disclosure of
personal information by these banks or third-party gateways.
- PAYMENT POLICY

You may pay the Fee by credit card, debit card, cash card, or online
banking. You agree to abide by the terms of the Company's agreements
with such third parties (i.e. payment gateways offering services
related to electronic payments and collections) who provide such
payment mechanisms, including but not limited to the payment of
transaction fees charged by such third parties to facilitate
payment.

You shall only be permitted to use the Services upon receipt of the
Fee in the Company's bank account. In the event that any payment,
despite having been completed at Your end, does not get credited to
the Company's bank account due to a flaw or failure in the payment
system, the Company shall not be liable for the incorrect charge to
your credit card/bank account. You shall solely deal with the third
party through which the money was channeled in the event of an
incorrect debit.

In the event that any transaction performed by you is discovered to
be in violation of the Website's Terms of Service, or if the
transaction is found to be irregular in any way, the transaction
shall be deemed null and void, and the Company shall cancel it. In
the event of such a transaction, if the payment has been credited to
the Company's bank account, it will be refunded to your credit
card/bank account within 7-10 working days, and you will be notified
through email and SMS.
- REFUND AND REFUNDING POLICY

If you wish to cancel a booking you have made, you may do so as
follows:

If a booking is made before 5 p.m. on a business day for sample
collection the following business day, you may cancel it or
defer it to another business day within the next 5 business days
by exercising either of the two options at any time before 9
p.m. on the day of your booking.

If a booking is made after 5 p.m. on a business day for sample
collection on the business day after the next business day, you
may cancel it or postpone it to another business day within the
next 5 business days by exercising any of the two choices by 5
p.m. on the following business day.

In the event that you do not exercise one of the two alternatives
outlined in paragraph 1 within the specified time period, your right
to claim Services shall be forfeited and the Fee paid by you shall
be forfeited by the Company. If, on the booking date or the
postponed date, as applicable, You failed to visit the testing
facility or failed to give the sample at the time of availing the
Home Service, Your right to claim Services shall be forfeited and
the Company shall retain the Fee paid by You.

If the Cancellation is made by You during the period specified in
paragraph 1, the money paid by You will be reimbursed to You within
7-10 working days, less a cancellation fee of 2.5% of the entire
invoice amount.

The refund amount will only be credited to the same credit card or
bank account from which the original payment was made.
- DELIVERY OF TEST REPORT (S)
-
You will receive a link to download your test report(s) via e-mail
to your registered e-mail address or via SMS/WhatsApp to your
registered mobile number once your test report(s) are ready. If you
have selected physical delivery of your test report(s), they will be
sent to you in the following manner:

If You provide the sample at the testing facility, you may collect
it in person at the testing facility on the date and time
specified at the time of sample collection.

If You utilized Home Service for sample collection, the test
report(s) will be sent to Your house on the date communicated to
You at the time of sample collection.
-
The test report(s) shall take 1-14 days (excluding Sundays)
depending on the nature of the test/health package(s), with the
exception of certain tests that may take longer if results are not
clear or if there are any Force Majeure events or if they are
performed by an international testing agency. You must provide any
additional information requested during the testing process within
24 hours of being notified of its necessity in order to receive
timely test results. The company will make every effort to deliver
on the requested day of delivery, but will not be held liable if
delivery does not occur on that day due to unforeseen circumstances.
